A catastrophic injury is one that means the person injured will need significant and long-term medical care. The injury may change forever the lives of both the injured person and his or her loved ones.
Spinal cord injuries and paralysis are examples of catastrophic injuries. Despite advances in medicine and technology, spinal cord injuries generally result in permanent injuries requiring life-time medical care, physical therapy, and rehabilitation.
Another example of a catastrophic injury is a traumatic brain injury (TBI). Even what may appear to be a minor concussion can result in months of debilitation with frequent headaches, nausea, lack of concentration and other symptoms caused by the head injury.
Some who suffer a TBI never recover or they may be unconscious for some time. There are those who never wake up and remain in a vegetative state for the rest of their lives, requiring round-the-clock care in order to live.
Some who suffer a catastrophic injury do eventually recover, but it may take years of therapy. Even those who make good progress in their recovery often need vocational rehabilitation and training if they are ever able to perform any type of work.
Damages for Catastrophic Injuries
Catastrophic injuries often require lifetime care. Damages available to someone who suffers a catastrophic injury include:
- Medical expenses for current medical care and for all medical care needed for the future.
- Compensation for required caregivers whether for a short period of time, or for life.
- Lost wages. This also includes what the injured person would have earned if they had not been injured. Even if the injured person is able to work at some job, if the job pays less than what they would have earned if they had not been injured, they are entitled to collect for the difference.
- Pain and suffering due to the loss of enjoyment of life.
There may be other damages available depending on the particular circumstances of the case.
